ANOTHER ASSAULT
ON RESIDENTIAL
ZONING

Ordinance Number 10.22.15
(no sponsor, yet) is on the
Albany Common Council
Meeting agenda for  Feb 19.

10.22.15 AN ORDINANCE AMENDING SECTION 375-7 (DEFINITIONS) AND SECTION 375-106 (HOME OCCUPATIONS) OF CHAPTER 375 (ZONING) OF THE CODE OF THE CITY OF ALBANY IN RELATION TO HOME OCCUPATIONS

Would strike existing law that the home 
occupation be incidential and secondary
to the use of the dwelling unit  

Would increase area of  building for
such use to 50 % of gross floor area
not to exceed 1,500 sq ft. 

strikes existing law prohibiting no
other partner, principal or professional
from being employed on site

would provide that  where more than
one owner of such dwelling exists, one
additional employee or assistant shall
be permitted to be engaged on the
premises in the home occupation.

This proposed ordinance
was approved as to form
Feb 6, 2015 by the City
Corporation Counsel.

This proposed ordinance
would adversely impact
the residential integrity
of the Buckingham Pond
Crestwood Neighborhood
as well as similar residential
neighborhoods in Wards
8,9,12, 13,14 and 15.

In turn, approval of this
ordinance would adversely
impact the city property
tax base, and, in turn
adversely impact support
for city schools and city
government services.

Withdraw Ordinance
Number  10.22.15 from 
consideration at the 
February 19  Albany
Common Council meeting
or at any future meeting.

No Member of the Albany
Common Council should
consent to sponsoring this
or any other proposed
ordinance that would 
compromise the residential
integrity, quality of  life of
existing predominantly
single family residential
zoned neighborhoods as
well as adversely impacting
the city property tax base
and financial support for
city schools and city
government services.
