ARTICLE 78 UPDATE
My Pro Se Article 78 proceeding
to annul the Albany City BZA
approval of the Bethany-Family
Promise Capital Region homeless
hub at 738 New Scotland Avenue
and asking the Court to affirm
the City Code Administrator's
denial of said use because such a
use is not permitted in an R 1b single
family residential zone, pursuant
to the Albany City Zoning Code
is before the NYS Supreme Court.
It has withstood 2 Motions to Dismiss
and a Decision will be made after
the November 3 General Election.
The Matter will be decided on the
law as, and why, it is so written.
In an "Interpretation Appeal"
the BZA is limited to interpreting
the City Zone Code as if it were
the City Code Administrator.The
language of the City Code must
be strictly construed.
All papers related thereto are on
file at the Office of the Albany
County Clerk.
